Magnolia Israel Tourism Ltd – Booking Conditions

1. Our Contract

All bookings are made with Magnolia Israel Tourism LTD (516551959) (“we/us”). By booking a trip, you agree to be bound by:
(a) these Booking Conditions; and
(b) the Everything You Need to Know manual.

These constitute the entire agreement between you and us. Services provided are as specified in your booking confirmation invoice.

2. Validity

Dates and itineraries are valid until 31 December 2030. Beyond this date, they are indicative only.

3. Deposit Requirement

A refundable deposit of USD $500 per person per trip is required to confirm a booking. Bookings made within 90 days of departure require full payment at the time of booking. Deposit amounts may vary for selected trips or special promotions and will be specified in your proposal.

4. Acceptance of Booking & Final Payment

A contract exists from the date we issue your booking confirmation invoice, or upon payment if booking within 90 days of departure. Final payment is due 90 days before departure, unless otherwise stated in your proposal. Failure to pay the balance by the due date allows us to treat the booking as cancelled, and cancellation terms (Clause 7) will apply.

5. Prices and Surcharges

Trip prices may vary based on demand, seasonal pricing, exchange rates, local operator costs, taxes, or government action.

  • We are responsible for up to 2% of any surcharge, with the traveler responsible for the balance.

  • Prices are non-refundable, and any discounts that become available after payment will not apply retroactively.

  • Credit card surcharges may apply.

6. Your Details

You must provide all requested personal details, including full name, date of birth, passport information, and any medical conditions affecting participation. Inaccurate or incomplete information may result in denial of services, with no refund.

7. Cancellation by You

  • 90 days or more prior to arrival: fully refundable.

  • 89 days or fewer: fully non-refundable, no credit issued.

Notes:

  • Different cancellation conditions may apply to certain trips or additional services, as outlined in your proposal.

  • Travel insurance is strongly recommended.

  • No refunds are given for unused services if a trip is partially or fully missed.

  • Cancellation charges are in addition to any fees imposed by third-party providers, including hotels, transport operators, and airlines.

8. Cancellation by Us / Force Majeure

A “Force Majeure Event” includes, but is not limited to: war, civil unrest, terrorism, acts of God, pandemics, extreme weather, government action, strikes, supply failures, or other circumstances beyond reasonable control.

If we cancel a trip due to a Force Majeure Event, you will be issued 100% credit for amounts paid, subject to the following conditions:

  • The credit is valid for one (1) year from the date of issue.

  • The credit is non-transferable and cannot be redeemed for cash.

  • The credit excludes flights, travel insurance, and optional third-party activities.

  • No additional compensation or reimbursement for incidental or consequential losses, including visas, vaccinations, or non-refundable flights, will be provided.

9. Booking Amendments

  • Transfers to a third party or alternative trip are permitted only when operationally possible.

  • No amendments are allowed within 90 days of departure.

  • Certain fees may apply.

10. Inclusions

The land price includes:

  • Accommodation as specified in your proposal

  • Transport as specified

  • Sightseeing and meals as specified

  • Services of a tour guide as described

11. Exclusions

The land price excludes:

  • International or internal flights unless specified

  • Airport transfers, taxes, and excess baggage charges unless specified

  • Meals not specified in the proposal

  • Visas, passports, and travel insurance

  • Optional activities and personal expenses

12. Age & Health Requirements

  • Under 18: must be accompanied by a legal guardian or a designated adult.

  • Maximum age: no upper age limit, but trips may be physically demanding. Travelers are responsible for obtaining medical advice at least two months prior to departure.

13. Supplemental Waivers

You may be required to sign additional waivers for certain trips or third-party suppliers. Booking Conditions prevail in case of conflict.

14. Passports & Visas

You are responsible for all travel documentation, visas, and permits. Failure to obtain proper documents is your responsibility, and any resulting costs or losses will be borne by you.

15. Travel Insurance
Travel insurance is mandatory for all travellers and must be obtained at the time of booking. Your policy must cover: personal accident, death, medical expenses, emergency evacuation, personal liability, and loss of luggage and personal effects.
Minimum recommended coverage is USD $250,000 per category. Travelers must provide the insurance company, policy number, and 24-hour emergency contact on the first day of the trip.
Travelers acknowledge that insurance may not cover trip cancellation, interruption, or political evacuation due to war or security risks in Israel. Travelers participate in the trip fully aware of this limitation.

16. Change of Itinerary

  • Trips may be altered due to local circumstances, Force Majeure, or safety concerns.

  • Travelers are responsible for additional costs or incidental expenses arising from changes, including visas, vaccinations, and non-refundable flights.

17. Authority on Tour

  • Tour guide decisions are final on matters affecting safety or well-being.

  • Failure to comply may result in removal from the trip with no refund.

  • Travelers must comply with laws, customs, and sustainable travel values.

18. Acceptance of Risk

You acknowledge that travel involves inherent risks, including but not limited to:

  • Extreme weather, challenging terrain, wildlife encounters

  • Civil unrest, terrorism, war, or other security threats

  • Accidents, illness, or natural hazards

Participation is voluntary. You assume full responsibility for your safety, and we disclaim all liability for personal injury, illness, loss, or death arising from these risks, to the fullest extent permitted by law.

19. Liability & Indemnity

19.1 Exclusion of Liability:
To the fullest extent permitted by law, we are not liable for direct, indirect, consequential, or incidental losses, including death or injury, except for fraud or willful misconduct.

19.2 Third-Party Providers:
We act only as an agent for third-party suppliers. We are not responsible for their acts, omissions, or negligence, and any claims must be addressed directly to the supplier.

19.3 Indemnity:
You indemnify Magnolia Israel and its affiliates for any claims arising from your participation, breach of terms, or acts of third parties.

19.4 Vicarious Liability:
We are not vicariously liable for actions of employees off duty or non-employees.

20. Optional Activities

Optional activities are not part of the contract. We are not liable for their provision or any incidents arising from them.

21. Claims & Complaints

Complaints must be raised immediately to your tour guide. Unresolved complaints must be submitted in writing within 30 days of the trip.

22. Severability

If any term is unenforceable, it will be severed or amended as necessary. Remaining terms remain binding.

23. Privacy Policy

Your personal information will be handled per our Privacy Policy and may be shared with suppliers to operate the trip.

24. Governing Law

Israeli law governs these conditions. Disputes must be filed in courts of Israel.

25. Assignment

We may assign or transfer our rights under these conditions at our discretion, with written notice to you.
